It lets you learn about the Owner&#8217;s services and get in touch with the Owner, for example by submitting an enquiry through the contact form. The Site may also offer a newsletter whose purpose is to inform about the Owner&#8217;s activities, news and new services. The law applicable to the Site, these terms and any agreements concluded on their basis is Polish law.<\/p>\n<p>The Site is not an online shop and it is not possible to conclude a contract of sale or a paid contract for the provision of services through it (this means, among other things, that adverts, price lists and other information about services published on the Site should not be treated as an offer, but at most as an invitation to conclude a contract). A contract for the provision of services may be concluded following an enquiry addressed to the Owner and only after the parties have agreed the detailed terms of that contract. The conclusion and terms of such a contract are, however, governed by separate general terms of service provided by the Owner, which the Owner will make available.<\/p>\n<h2 id=\"personal-data\">Personal data<\/h2>\n<p>The controller of personal data processed on the Site is the Owner. Personal data is processed for the purposes, to the extent and on the basis and principles set out in the privacy policy published on the Site. The privacy policy sets out, above all, the rules for the processing of personal data by the Controller on the Site, including the grounds, purposes and scope of processing and the rights of data subjects, as well as information about the use of cookies and analytics tools on the Site. Use of the Site is voluntary. Likewise, the related provision of personal data by a person using the Site is voluntary, subject to the exceptions set out in the privacy policy (for example, the use of electronic services and the Owner&#8217;s statutory obligations).<\/p>\n<h2 id=\"using-the-site\">Using the Site<\/h2>\n<p>The Site is available to all internet users. The Site should be used in a manner consistent with the law and good practice, with respect for personal rights, the protection of personal data and the rights of the Controller, other users of the Site and third parties, including copyright and intellectual property rights. Unlawful activities that could disrupt the operation of the Site are prohibited. Providing unlawful content is also prohibited. You can stop using the Site at any time by closing the website or the web browser.<\/p>\n<p>All information and data sent by users through the Site should be accurate and contain true information. It is not permitted to send content that breaches the rules of netiquette or that contains offensive information or unlawfully harms the Owner&#8217;s reputation, or that could mislead the Owner or other people. Users are prohibited from using the Site to distribute unsolicited commercial information (spam).<\/p>\n<p>Using the Site involves the standard risks present on the internet. The basic risk for every internet user is the possibility of a computer system being &#8220;infected&#8221; by various types of malicious software created mainly to cause harm or to gain unauthorised access to a user&#8217;s data. We will respond to your report within 14 calendar days.<\/p>\n<h2 id=\"electronic-services\">Electronic services available on the Site<\/h2>\n<p>Besides the ability to view information and other content on the Site, the following electronic service is also available: the contact form.<\/p>\n<h3 id=\"contact-form\">Contact form<\/h3>\n<p>The contact form lets you send an enquiry to the Owner. Sending an enquiry does not create any obligations for the user or the Owner, it is only a way to get in touch with the Owner.<\/p>\n<p>Use of the contact form begins the moment you start filling it in on the Site, normally it is available in the &#8220;Contact&#8221; tab. An enquiry is sent once two consecutive steps are completed together: (1) filling in the contact form with the data marked as mandatory, and (2) clicking the action button placed below the form after filling it in. Until then you can modify the data you have entered. The contact form requires the contact details of the person filling it in: name, email address and phone number.<\/p>\n<p>The contact form electronic service is provided free of charge and is a one-off service that ends when the user sends an enquiry through it, or when the user stops formulating an enquiry through it beforehand.<\/p>\n<h2 id=\"copyright\">Copyright<\/h2>\n<p>Copyright and intellectual property rights to the Site as a whole and to the content, graphics, works, designs and marks available within it belong to the Owner or other authorised third parties and are protected by copyright and other generally applicable laws. Use of the content published on the Site is permitted without restriction for your own personal use. Use of the content published on the Site in any other way requires the prior express consent of the Controller or other authorised third parties.<\/p>\n<h2 id=\"reviews\">Reviews<\/h2>\n<p>The Owner does not allow customers to leave reviews of the services provided through the Site.<\/p>\n<p>The Owner may send customers who have used its services invitations to leave a review, including by email. The Owner may publish on the Site reviews obtained in this way in the section dedicated to reviews. Reviews are verified to check whether their author has used the Owner&#8217;s services, an invitation to leave a review is sent only to a person who has used the Owner&#8217;s services.<\/p>\n<p>Leaving and publishing a review may not be used for unlawful activities, in particular for acts of unfair competition, or activities that infringe personal rights, intellectual property rights or other rights of the service provider or third parties. A person writing a review is obliged to act in accordance with the law, these terms and good practice.<\/p>\n<p>Any comments or objections regarding reviews published on the Site can be reported using the methods below:<\/p>\n<ul class=\"wp-block-list\"><li>email: <a href=\"mailto:kontakt@demo.agencjacudo.pl\">kontakt@demo.agencjacudo.pl<\/a><\/li><li>the contact form available on the Site<\/li><li>phone: <a href=\"tel:+48455444000\">+48 455444000<\/a> (call charged as a standard phone call, in line with your provider&#8217;s tariff plan)<\/li><\/ul>\n<p>The Owner does not post, and does not commission anyone else to post, false reviews or recommendations from customers, and does not distort customers&#8217; reviews or recommendations in order to promote its services.<\/p>\n<h2 id=\"illegal-content\">Provisions on illegal content<\/h2>\n<p>Illegal content is information that, in itself or by reference to an activity, including the sale of products or the provision of services, is not in compliance with the law of the European Union or the law of any Member State that is in compliance with the law of the European Union, irrespective of the precise subject matter or nature of that law (the &#8220;Illegal content&#8221;).<\/p>\n<p>The rules on illegal content are set out, among other places, in the Digital Services Act, Regulation (EU) 2022\/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market For Digital Services and amending Directive 2000\/31\/EC (Digital Services Act) (OJ L 277, 27.10.2022, p. 1 to 102) (the &#8220;Digital Services Act&#8221;).<\/p>\n<p>This section of the terms contains provisions arising from the Digital Services Act insofar as they concern the Site and its Owner. In principle, a person using the Site is not obliged to provide content while using it. A person using the Site may, however, be able to provide content when filling in the contact form or adding a comment on the Site using the tools made available for this purpose by the Owner. In every case where a person using the Site provides content, they are obliged to follow the rules set out in the terms.<\/p>\n<p><strong>POINT OF CONTACT<\/strong>. The Owner designates the email address <a href=\"mailto:kontakt@demo.agencjacudo.pl\">kontakt@demo.agencjacudo.pl<\/a> as a single point of contact. The point of contact enables the Owner to communicate directly with Member State authorities, the European Commission and the Digital Services Board, and at the same time enables recipients of the service (including people using the Site) to communicate directly, quickly and in a user-friendly manner with the Owner by electronic means, for the purposes of the Digital Services Act. The Owner indicates Polish and English as the languages for communication with its point of contact.<\/p>\n<p><strong>Procedure for reporting Illegal content and acting under Article 16 of the Digital Services Act:<\/strong><\/p>\n<ol>\n<li>Any individual or entity may notify the Owner, at the email address <a href=\"mailto:kontakt@demo.agencjacudo.pl\">kontakt@demo.agencjacudo.pl<\/a>, of the presence of specific information that the individual or entity considers to be Illegal content.<\/li>\n<li>The notice should be sufficiently precise and adequately substantiated. To this end the Owner enables and facilitates the submission, to the email address indicated above, of notices containing the following elements: (1) a sufficiently substantiated explanation of the reasons why the individual or entity alleges the information in question to be Illegal content; (2) a clear indication of the exact electronic location of that information, such as the exact URL or URLs, and, where necessary, additional information enabling the identification of the Illegal content adapted to the type of content and to the specific type of service; (3) the name and email address of the individual or entity submitting the notice, except in the case of a notice concerning information considered to involve one of the offences referred to in Articles 3 to 7 of Directive 2011\/93\/EU; and (4) a statement confirming the good faith belief of the individual or entity submitting the notice that the information and allegations contained in it are accurate and complete.<\/li>\n<li>The notice referred to above is considered to give rise to actual knowledge or awareness for the purposes of Article 6 of the Digital Services Act in respect of the information concerned, where it allows the Owner, acting with due diligence, to identify the illegality of the relevant activity or information without a detailed legal examination.<\/li>\n<li>Where a notice contains electronic contact details of the individual or entity that submitted it, the Owner sends that individual or entity a confirmation of receipt of the notice without undue delay. The Owner also notifies that individual or entity, without undue delay, of its decision in respect of the information to which the notice relates, providing information on the possibilities for redress against that decision.<\/li>\n<li>The Owner processes all notices it receives under the mechanism referred to above and takes decisions in respect of the information to which the notices relate in a timely, non-arbitrary and objective manner and with due diligence. Where the Owner uses automated means for such processing or decision-making, it includes information about this in the notification referred to in the previous point.<\/li>\n<\/ol>\n<p><strong>Information about the restrictions the Owner imposes in connection with the use of the Site, in relation to content provided by people using the Site:<\/strong><\/p>\n<ol>\n<li>The following rules apply to a person using the Site when providing any content on the Site:\n<ol type=\"a\">\n<li>an obligation to use the Site, including posting content (for example in comments), in accordance with its purpose, these terms and in a manner consistent with the law and good practice, with respect for personal rights and the copyright and intellectual property rights of the Owner and third parties;<\/li>\n<li>an obligation to enter content that is consistent with the facts and in a way that is not misleading;<\/li>\n<li>a prohibition on providing unlawful content, including a prohibition on providing Illegal content;<\/li>\n<li>a prohibition on sending unsolicited commercial information (spam) through the Site;<\/li>\n<li>a prohibition on providing content that breaches generally accepted rules of netiquette, including content that is vulgar or offensive;<\/li>\n<li>an obligation to hold, where necessary, all required rights and permissions to provide such content on the Site, in particular copyright or the required licences, permissions and consents for its use, distribution, sharing or publication, especially the right to publish and distribute it on the Site (where necessary), and the right to use and distribute an image or personal data in the case of content that includes the image or personal data of third parties;<\/li>\n<li>an obligation to use the Site in a way that does not create a risk to the security of the IT system of the Owner, the Site or third parties.<\/li>\n<\/ol>\n<\/li>\n<li>The Owner reserves the right to moderate content provided by people using the Site. Moderation is carried out in good faith and with due diligence, on the Owner&#8217;s own initiative or in response to a notice received, in order to detect, identify and remove Illegal content or other content that does not comply with the terms, or to disable access to it, or to take the measures necessary to meet the requirements of European Union law and national law compliant with European Union law, including the requirements set out in the Digital Services Act, or the requirements set out in the terms.<\/li>\n<li>The moderation process may be carried out manually by a person or may rely on automated or partly automated tools that help the Owner identify Illegal content or other content that does not comply with the terms. Once such content is identified, the Owner decides whether to remove it or disable access to it, or otherwise limits its visibility, or takes other action it considers necessary (for example contacting the author to clarify objections and change the content). The Owner will inform the person who provided the content (where it has their contact details), in a clear and easily understandable way, of its decision, the reasons for it and the available options for redress against that decision.<\/li>\n<li>In exercising its rights and obligations under the Digital Services Act, the Owner is obliged to act with due diligence, in an objective and proportionate manner and with due regard to the rights and legitimate interests of all parties involved, including the recipients of the service, in particular with regard to the rights set out in the Charter of Fundamental Rights of the European Union, such as freedom of expression, freedom and pluralism of the media and other fundamental rights and freedoms.<\/li>\n<\/ol>\n<p>Any comments, complaints, appeals or objections regarding decisions or other actions or a lack of action taken by the Owner on the basis of a notice received, or a decision taken by the Owner in accordance with these terms, may be submitted in a manner analogous to the complaints procedure set out above in the terms in the part about using the Site. Use of this procedure is free of charge and allows complaints to be submitted electronically to the email address provided. Use of the complaint submission and handling procedure is without prejudice to the right of the individual or entity to bring proceedings before a court and does not affect their other rights.<\/p>\n<p>The Owner processes all comments, complaints, appeals or objections regarding decisions or other actions or a lack of action taken by the Owner on the basis of a notice received or a decision taken, in a timely, non-discriminatory, objective and non-arbitrary manner. Where a complaint or other report contains sufficient grounds for the Owner to consider that its decision not to act in response to the notice is unfounded, or that the information to which the complaint relates is not illegal and does not breach the terms, or contains information indicating that the complainant&#8217;s conduct does not warrant the measure taken, the Owner, without undue delay, reverses or amends its decision to remove or disable access to the content or otherwise limit its visibility, or takes other action it considers necessary.<\/p>\n<p>Individuals or entities that have submitted a notice of Illegal content and to whom the Owner&#8217;s decisions on Illegal content or content that does not comply with the terms are addressed, have the right to select any out-of-court dispute settlement body certified by the Digital Services Coordinator of a Member State to resolve disputes concerning those decisions, including in relation to complaints that have not been resolved through the Owner&#8217;s internal complaint-handling system.<\/p>\n<h2 id=\"external-links\">External links<\/h2>\n<p>The Site may contain links to other websites.
